Understanding Your Situation

Relationship Property Agreements may be needed:

  • when planning ahead (known as Contracting-Out Agreements / Section 21 Agreements or Pre-nups); or
  • after separation where matters are agreed; or
  • after separation where there is disagreement.

The following process will guide you to the correct form. Once there, we will be asking for information in relation to your and your partner's situations both separately and together. That information will assist us to draft the appropriate Agreement.

How it works:

  • You complete a short triage form.
  • You are then directed to the appropriate information collection form, either :
    • Contracting-Out Agreement; or
    • Separation (Agreed); or
    • Separation (Disputed).

Please note the following important points:

  • This triage form is only used to direct you to the correct form.
  • You will be providing information to the best of your knowledge and understanding.
  • You should Include all property and liabilities you are aware of, whether:
    • in your name; and
    • in your partner’s name; and
    • jointly owned or held; and
    • held through trusts, companies or businesses.
  • If you are unsure of anything, there are Comments fields in every section where you can simply include the information you have.
